1. Acceptance of Terms
By accessing or using encrypt.lu, you agree to these Terms of Use and the associated Privacy Policy. If you do not agree, you must not use the service.
The Privacy Policy forms an integral part of these Terms.
2. Description of the Service
encrypt.lu provides a browser-based file encryption and transfer tool. All encryption and password-based key derivation occur entirely in the user's browser.
The operator:
- Does not receive encryption keys
- Does not receive passwords
- Cannot decrypt user files
- Stores only encrypted data
The service is a technical tool and not a managed storage or archiving service.
3. Service Provided "As Is"
The service is provided:
- "As is"
- "As available"
- Without warranties of any kind
The operator makes no guarantees regarding:
- Continuous availability
- Error-free operation
- Fitness for a particular purpose
- Commercial suitability
- Data durability
Use of the service is entirely at your own risk.
4. No Enterprise or Regulatory Warranty
The service is not:
- A certified backup solution
- A regulated data archive
- A compliance storage system
- A guaranteed secure communications channel
You remain solely responsible for compliance with any legal or regulatory obligations applicable to you.
5. User Responsibilities
You are solely responsible for:
- The legality of uploaded content
- Protecting share links
- Protecting passwords
- Maintaining independent backups
- Verifying integrity of encrypted and decrypted files
Lost passwords, lost links, or deleted files cannot be recovered. The operator has no technical ability to restore encrypted content.
6. Prohibited Use
You may not use the service for:
- Illegal content
- Malware distribution
- Copyright infringement
- Harassment or threats
- Terrorism-related material
- Sanctions violations
- Any activity violating Luxembourg or EU law
The operator reserves the right to:
- Delete transfers
- Disable access
- Block usage
- Cooperate with lawful requests from authorities
7. Abuse Reporting
If you believe the service is being used unlawfully, you may report it to:
Reports should include sufficient detail to identify the transfer in question. The operator does not monitor or inspect encrypted content but may remove access to transfers when credible abuse is reported.
8. Retention and Deletion
Files are automatically deleted after the selected retention period. If "delete after first download" is enabled, deletion occurs immediately after successful download.
The operator does not guarantee deletion in cases of:
- Infrastructure failure
- Force majeure
- Events outside reasonable control
Deletion mechanisms are implemented in good faith but without absolute warranty.
9. Limitation of Liability
To the maximum extent permitted by law, the operator shall not be liable for:
- Loss of data
- Loss of profits
- Business interruption
- Indirect or consequential damages
- Loss resulting from lost passwords or links
- Unauthorized access caused by user negligence
- Temporary or permanent unavailability of the service
Any liability that cannot legally be excluded shall be limited to the minimum extent permitted by Luxembourg law.
Nothing in these Terms excludes or limits liability where such exclusion is prohibited by mandatory law, including liability for intentional misconduct or gross negligence.
10. Consumer Rights
Nothing in these Terms affects non-waivable rights granted to consumers under applicable Luxembourg or EU law. If you are a consumer within the meaning of EU law, you retain all mandatory statutory rights.
11. Age Requirement
The service is not directed at minors under the age of 16. By using the service, you represent that you meet any applicable age requirements under your national law.
12. Suspension and Termination
The operator may suspend or terminate access at any time:
- For abuse
- For legal compliance
- For security reasons
- For maintenance
- At sole discretion
No compensation shall be owed for suspension or termination.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Luxembourg. Exclusive jurisdiction lies with the courts of Luxembourg, unless mandatory consumer protection rules provide otherwise.
14. Severability
If any provision of these Terms is found invalid or unenforceable, the remainder shall remain in effect.
